2 Men Die In Crash with Tractor-Trailer In Clay County Kentucky

Matthew Troutman Dec. 17, 2022

On December 15, 2022, at approximately 7:30 pm an auto accident occurred when a tractor-trailer crossed the center line on Hal Rodgers Parkway in Clay County Kentucky and struck a pickup truck occupied by William Collins of Emmalena and Tanner Reisig of Paint Lick, Kentucky. They were pronounced dead at the scene by the Clay County Coroner. A very sad day when people lose their lives unnecessarily in a car wreck. There is no information, at this time, as to why the tractor trailer crossed the center line. I have always wondered if we would be better off to only have one-way streets to avoid these type of accidents that are frequently deadly due to a severe impact caused by vehicles traveling in opposite directions.

STAY AWAY FROM BIG TRUCKS

Any accident between an automobile or pick-up truck and a commercial truck never ends well. Severe injuries or death result. The same can be said of motorcycle accident where the rider has little or no protection from injury during an accident. This has lead me to do whatever I can to avoid contact with commercial vehicles. I do not sit behind them where they can block my vision and generally I pass them on the Interstate and do whatever I can to stay away from them.

WRONGFUL DEATH CLAIM IS DIFFERENT THAN PERSONAL INJURY CLAIM

Any accident involving the death of an auto accident victim has different challenges than the normal car accident claim. First of all, an estate must be set up, and sometimes there can be a fight over who can represent the estate. The other significant difference is that a wrongful death claim has a 1-year statute of limitations as opposed to the 2 years from the last PIP payment on a normal auto accident injury claim. The wrongful death claim is controlled by statute and is mainly a lost income claim. You can make a personal injury pain and suffering claim and a wrongful death claim if it is proven by medical evidence that the decedent survived the accident for a period of time and was conscious during the time between the accident and his or her death. The value of a wrongful death claim is usually dependent upon the age of the decedent at the time of death. The younger the age at death, the longer period of time for lost wages and, thus, the larger the claim.
